Terms of Service & Membership Agreement
These Terms and Conditions constitute a legally binding agreement between you and Bari Vivah Matrimony regarding your registration, profile creation, and matchmaking services on www.barivivah.in.
Preamble & Agreement to Terms
Welcome to Bari Vivah Matrimony (hereinafter referred to as "Bari Vivah," "Website," "Company," "We," "Us," or "Our"). By accessing, browsing, registering an account on www.barivivah.in, or using our mobile applications, you agree to be bound by the following Terms and Conditions, Community Guidelines, and provide your explicit consent for data processing under Indian Law.
These Terms of Service govern your membership and use of all related digital matchmaking tools, verified candidate profiles, contact unlocking mechanisms, and matchmaking algorithms.
If you do not agree to all terms, conditions, and privacy policies set forth herein, you must immediately refrain from registering or using the Bari Vivah website and applications.
1. Eligibility & Minimum Age
Membership and access to Bari Vivah is strictly restricted to individuals who fulfill the following statutory and policy qualifications:

Any account created by a minor, or found misrepresenting age, marital status (e.g. concealing existing marriage), or identity, will be permanently terminated with immediate effect.
2. Registration & Account Security
2.1. Truthful Representations: You agree to provide true, accurate, current, and verifiable information during registration (including candidate photograph, family particulars, educational qualifications, caste, and contact details).
2.2. Login Credentials Confidentiality: You are solely responsible for maintaining the strict confidentiality of your OTPs, passwords, and Unique Profile ID (e.g. BV-XXXXXX). You must not disclose or share login credentials with any third party.
2.3. Account Responsibility: Any action, inquiry, message, or connection request initiated under your authenticated mobile number or credentials will be deemed executed directly by you or your authorized family guardian.
3. Role of Bari Vivah (Intermediary Status)
Intermediary Status under Section 79 of the IT Act, 2000
Bari Vivah acts strictly as an electronic intermediary and discovery platform. We provide tools for community members to publish profiles and explore mutual matrimonial compatibility. We do not act as marriage brokers or match guarantors.
No Guarantee of Marriage Proposals or Compatibility
Bari Vivah does not guarantee that registered members will find a compatible life partner, receive responses to connection requests, or conclude a marriage alliance. Match compatibility percentages are calculated algorithmically based solely on user-submitted preferences.
Independent Verification Advisory
While Bari Vivah offers verification trust badges based on submitted government IDs and live photos, all members and their families are strongly urged to conduct independent reference checks, physical residential visits, financial verification, and due diligence before finalizing any matrimonial alliance.

5. Privacy & DPDP Act 2023 Consent
In compliance with the Digital Personal Data Protection (DPDP) Act, 2023, you grant your Explicit and Informed Consent to Bari Vivah for the following processing activities:
A. Data Collection
Collecting candidate details (Name, DOB, Religion, Caste, Income, Profession, Horoscope, and Photos) for matchmaking.
B. Profile Visibility
Displaying your profile to verified community members based on your configured privacy settings.
C. Multi-Channel Alerts
Receiving match notifications, OTPs, SMS, WhatsApp updates, and emails regarding account activity.
D. Secure Infrastructure
Sharing payment metadata with PCI-DSS compliant payment gateways (Razorpay) for membership checkout.
6. Membership Fees, Invoicing & Refund Policy
6.1. Nature of Services: Bari Vivah offers both free discovery tier and premium membership plans (providing benefits such as direct contact unlocks, verified profile filters, and priority placement).
6.2. Strict Non-Refundable Policy: Because membership grants immediate digital access to private candidate profiles and contact unlock credits, all membership fees are strictly non-refundable once paid and activated. No pro-rata refunds will be issued for early account deletion or finding a partner prior to plan expiration.
6.3. Payment Disputes: If you notice an unauthorized or duplicate debit, you must notify our billing desk in writing within 7 days of the transaction date with invoice details.
6.4. Statutory GST Invoicing: All subscription fees are inclusive/exclusive of applicable Goods and Services Tax (SAC 998599). Computer-generated digital tax invoices are available in your Account Invoices section.
7. Account Termination & Profile Deletion
7.1. Termination for Violation: Bari Vivah reserves the right to suspend or terminate your membership without notice or refund if you breach these terms, post fraudulent details, or receive multiple verified member complaints.
7.2. Voluntary Deletion: You have the right to permanently delete your profile at any time through Account Settings. Upon deletion, your candidate card will be removed from all searches immediately.
8. Limitation of Liability & Indemnity
To the maximum extent permitted by Indian Law, Bari Vivah Matrimony, its directors, officers, and technical team shall not be liable for any indirect, punitive, incidental, special, or consequential damages, loss of reputation, or financial losses arising from:
- Personal meetings, financial exchanges, or matrimonial agreements conducted outside the platform.
- Misrepresentations or inaccurate information posted by other registered users.
- Temporary service interruptions, scheduled server maintenance, or telecommunication failures.
9. Governing Law & Exclusive Jurisdiction
This Agreement and all associated relationship policies shall be governed by, interpreted, and construed in accordance with the substantive laws of the Republic of India. Any dispute, difference, controversy, or claim arising out of or relating to this Agreement shall be subject to the exclusive territorial jurisdiction of the competent civil courts in Pune, Maharashtra, India.
